Head-crushing injury on the job leads to lawsuit in West Virginia

A Huntington area man is suing a rebuilding company and a product manufacturer for disabling injuries he suffered on the job while operating a Roof Bolter machine. His suit states that when he was operating tasks from the Roof Bolter machine’s cabin, the machinery came down on the compartment crushing his head and body. He was severely injured in the accident and left permanently disabled. 

Workplace injuries on construction and building sites are not altogether uncommon; however, this suit alleges unsafe practices regarding a very dangerous piece of machinery. Moreover, the man’s suit asserts that part of the machinery was defective and that the machine’s makers and associated building company “failed to provide warning, instructions and notice to the users of the Roof Bolter.” 

The man asserts that no safety measures were in place for him that could have prevented the accident that caused his permanent disability. 

In essence, this workplace accident victim was injured by what he deems a dangerous piece of equipment. His disability has left him with both severe pain and mental anguish. Aside from the crushing of his head, he also sustained other injuries to his body that have altered his basic human functions and left him with a limp. 

Along with his wife, he is suing these two companies for compensation and punitive damages.  With his earning capacity greatly affected and his life unalterably changed, this man must seek legal recourse for the dangerous work environment that severely injured him.

Those who are injured in workplace accidents often benefit from legal guidance. Compensation is often available for medical expenses, lost wages and pain and suffering, but in many cases it is not easy for victims and their loved ones to obtain the compensation they deserve.
