A denied disability claim is not the end of the road

The inability to work, provide for your West Virginia family and pursue a successful and fulfilling career is frustrating, but you may find yourself even more discouraged to learn that your application for disability benefits did not receive approval. This is certainly a setback, but this is not the end of the road for you.

Fighting back against a denied claim can be a daunting prospect. Where do you go from here? Who can help you appeal and eventually secure the benefits you need? Who is eligible for disability benefits?

Not everyone who applies with the Social Security Administration for disability benefits will receive support. In fact, many first time claims come back denied. According to SSA regulations, you must meet two basic requirements to be eligible for SSD benefits:

  • Your application did not include the necessary medical documentation needed to validate your claim.

You may have a valid, qualifying condition, but one mistake or misinterpretation of the documentation can result in denial. With the appropriate legal assistance, you can try again by requesting reconsideration of your application or through an administrative appeal. Ultimately, you have the right to file a lawsuit to have your case heard in a federal court.
