What Is Medical Malpractice?

Doctors are human beings, and no one is expected to be infallible. However, medical professionals have a duty to exercise reasonable care and to act as a reasonably prudent physician would in similar circumstances. If a doctor fails to do so, and you are injured as a result, you may have a case of medical malpractice.

Was My Medical Provider Negligent?

There are known risks to any medical procedure, and no one is guaranteed that their medical procedure will be successful. As long as your doctor warned you of these risks and did everything that a prudent physician would do in providing your care, he or she would not be guilty of medical malpractice.

It can be difficult to determine whether a doctor did everything that he or she should have in providing your care. Unless you are a doctor yourself, you are not likely to know what a reasonably prudent physician would have done. For this reason, most states require your lawyer to obtain expert opinions from other physicians and experts.
