West Virginia nursing home accused of negligent death of resident

A woman has filed a lawsuit against a West Virginia nursing home in relation to her mother’s death. Genesis Healthcare as well as several related companies, management services and numerous ‘John Does’ was listed in the lawsuit. The complaint alleges corporate negligence in relation to the death of a woman back in February 2013.

The complaint was filed on Nov. 5 in the Kanawha Circuit Court. It states that the decedent was a victim of nursing home neglect during her stay in the home between October and November 2012. The suit alleges that the elderly mother received improper care, which included fluid overload and medication error, from the facility’s staff. The filing claims that these types of mistakes led to the patient’s death only a few months later.

The complaint further goes on to say that the facility presented itself as being able to properly care for patients, but management plans, reports and surveys prove that residents could not properly be cared for due to financial difficulties, which restricted necessary functions related to supplies and staffing. In addition to accusations of West Virginia Consumer Credit and Protection Act violations, the defendants are accused of nursing home violations, negligence, corporate negligence, premises liability and a number of other torts.

People expect their loved ones to be cared for when they are residing in nursing homes, but in some cases, the negligence of staff or even corporate owners and managers can prevent this from happening. This type of reckless endangerment could result in serious injuries or even death. With legal assistance, however, it is possible for victims and their families to recover appropriate financial compensation.
