Seeking damages for victims of nursing home abuse

Placing a loved one in a nursing home is a difficult, complicated decision for any West Virginia family. Often, this step comes as the result of a loved one being unable to meet his or her own basic needs, or because he or she needs medical or physical assistance. Every facility that provides inpatient care for elderly adults has the responsibility to provide quality care and service.

It is unnerving to learn that your loved one could be the victim of any type of abuse or neglect at the hands of the people who are supposed to be providing care. You naturally feel angry and overwhelmed, but there are options available to your family. There is no need to walk through this situation alone.

When should you pursue legal action?

Perhaps you notice signs of physical harm or neglect, such as unexplained bruises or bedsores, or you may suspect that depression and sudden weight loss could be the result of mental and emotional trauma. Whatever you believe happened, you have the right to know and the right to fight back. If there is evidence of any type of wrongdoing, you certainly have grounds to move forward with a civil claim.

Taking legal action is not an easy process, but it is important that nursing homes and liable parties be accountable for the suffering experienced by your loved one. Nursing homes can be negligent in many different ways, and one or more of these negligent actions could be the source of your family’s misfortune. They are as follows:

  • Negligent or reckless hiring practices, such as hiring untrained individuals
  • Exhibiting negligence in the care and supervision provided for residents
  • Negligent maintenance of the facility and premises, leading to injury risks
  • Failure to maintain safe, maintained and properly functioning equipment

Determining the right course of action for your family is not an easy decision. Whether you are just suspicious of the care your loved one is receiving or you have actual evidence of wrongdoing, you would be wise to seek answers as soon as possible.

The recovery your loved one deserves

Nursing home abuse or neglect is a serious issue. Those who suffered needlessly at the hands of others could have a rightful claim to financial compensation, and you have the right to take action on behalf of your family member. You can hold facilities accountable for negligent care, and the first step of this process is simply to seek a thorough evaluation of your case and explanation of the various choices your family may have.
