Did you experience setbacks with your disability claim?

When you are dealing with an injury or a sickness that makes it difficult or impossible for you to work, you may struggle with earning a living. Individuals who are unable to hold gainful employment because of a physical or mental condition could be eligible for benefits through the Social Security Administration. If you cannot work, you could have a rightful claim to this type of support.

Upon completing your claim, it can be surprising to learn that the SSA did not approve your claim. In reality, many initial disability claims come back denied, even when a person has a valid medical condition. This is not the end, however; you can appeal and continue your pursuit of rightful benefits.

Why claims come back denied

You have the right to appeal after a denied claim. One of the first steps in this process is to try to understand what factors may have played a role in why your claim did not get approval. Once you identify the reason, you can then move forward with an appeals effort. Some of the most common reasons for a claim denial include:

  • There is no evidence that the disability will last for more than one year.
  • It is possible the disability relates to some form of drug or alcohol abuse.
  • You did not include sufficient medical records in your claim.
  • The SSA has not been able to contact you regarding your claim.
  • You did not follow directions during the claims process.

These are among some of the most frequently cited reasons why the SSA denies disability claims. If this happened to you, it is certainly a setback, but you can continue your fight to get the benefits you need. If the reason given does not apply to your situation or you can provide documentation to the contrary, you may want to move forward with the appeals process as soon as possible.

Your fight for support

Successfully applying for and obtaining the benefits you deserve can be a fight. It can take a long time, and you may experience setbacks, but you do not have to walk through this process alone. Like other applicants, you may find it beneficial to work with a West Virginia attorney who can help you navigate each step and deal with complications as they arise.

Before you move forward with your claim, you may want to start with a complete evaluation of your case and an explanation of what to expect from the disability claims process.
