What Can I Do If My Insurance Company Lowballs My Claim?

What Is Lowballing?

Lowballing refers to an attempt by an insurance company to pay you less than is reasonable for your property damage claim. For example, if all available evidence suggests that your claim is worth $100,000, and the insurance company offers you $60,000, it may be guilty of lowballing.

What Are My Legal Options If My Insurance Company Lowballs My Claim?

Your insurance company owes you certain duties because you paid it premiums. Among those duties are to act in good faith and deal with you fairly. For example, if your home is damaged, your insurance company has a duty to fairly evaluate the damage and make a good faith offer to settle your claim. If instead the insurance company makes a settlement offer that is unreasonably low, it may be violating its duty to you. In this case, you may have a legal claim for insurance bad faith, in addition to your underlying claim for property damage.
